Leave entitlements under Thai labour law in 2026: what employers should know
Draft article — the legal points are still being checked against the statutes. Anything marked [to verify] is not yet confirmed.
The law sets minimum leave entitlements. A company may give more, but not less. This table summarises the main types.
Check the figures and section numbers in this article against the latest Labour Protection Act before relying on them, especially maternity leave and leave for a spouse, which were amended during 2025 [to verify].
| Type | Minimum entitlement | Pay during leave |
|---|---|---|
| Sick leave | As long as the employee is actually ill · for 3 or more working days the employer may ask for a medical certificate (section 32 [to verify]) | Paid for up to 30 working days a year (section 57 [to verify]) |
| Annual leave | After one year of service, at least 6 working days a year (section 30 [to verify]) | Paid |
| Personal (necessary business) leave | At least 3 working days a year (section 34 [to verify]) | Paid for up to 3 working days a year (section 57/1 [to verify]) |
| Maternity leave | [to verify] — previously 98 days per pregnancy, including prenatal check-ups (section 41), and extended by the 2025 amendment | [to verify] — previously paid by the employer for up to 45 days (section 59) |
| Sterilisation leave | For the period set and certified by a doctor (section 33 [to verify]) | Paid [to verify] |
| Military service leave | As called up (section 35 [to verify]) | Paid for up to 60 days a year (section 58 [to verify]) |
| Traditional (public) holidays | At least 13 days a year, including National Labour Day (section 29 [to verify]) | Paid |
| Weekly holiday | At least 1 day a week (section 28 [to verify]) | Depends on the type of employee [to verify] |
What the company has to decide for itself
- Whether to give more than the minimum, for example extra annual leave with length of service.
- Whether employees in their first year get annual leave pro rata.
- Whether unused annual leave carries over, and how many days.
- How far in advance leave must be requested, and which types need a document.
These points belong in the company's work rules.
Setting this up in PANN HR
PANN HR starts each company with defaults: 6 days' annual leave, 30 days' sick leave and 3 days' personal leave a year, a leave year starting in January, and no carry-over. All of it can be changed in Settings, including quotas by length of service and advance-notice rules.
